Image rights terms and conditions

When accepting rights requests you are allowing University of Derby (the “University”) to use your personal social media content (your “Content”) on the University’s media and for internal and/or external communication purposes free of charge.

The University will request rights to use your Content in accordance with these terms and conditions by making or posting a comment (the “Comment”) on your Instagram post or through Twitter or howsoever may be applicable to the social media on which you have posted your Content. The Comment will request a response from you authorising the University to use your Content. To agree to the University using your Content, simply reply to the Comment or tweet using the hashtag #DerbyUniYes (the “Hashtag”).

By replying to the Comment using the Hashtag you are confirming that you are the legal and beneficial owner of all the intellectual property rights in your Content (other than any third party logos or brand names featuring in your Content), that it is your original work and does not infringe any third party rights, including patents, trademarks, copyright, unregistered rights or any other rights that may subsist in it and that you give the University an non-exclusive, irrevocable, transferable, royalty-free licence to use the Content in any media throughout the world, including but not limited to its websites, presentations, and promotional materials, and in internal or external communication, free of charge.

By replying to the Comment using the Hashtag you warrant that you have obtained all relevant rights and permissions from individuals featuring in your Content, and that your Content does not feature anyone under the age of 18 unless it is your own child and you confirm that you are the child’s parent or guardian and consent to the Content being used by the University as set out in these terms and conditions.

By replying to the Comment using the Hashtag you agree to indemnify the University immediately and in full against any and all actions, claims, costs, demands, expenses and other liabilities suffered or incurred by the University as a result of any: third party alleging to have intellectual property rights in or infringed by the Content; the exercise of the rights granted to the University under these terms and conditions; and any and all damage caused whether directly or indirectly from or in relation to any rights, laws or regulations violated by the Content.

By replying to the Comment using the Hashtag you confirm that you do not object to the University storing copies of the Content in any form for the purposes set out above, transferring the Content outside of the European Economic Area (“EEA”) or storing the Content at a destination outside of the EEA for the purposes set out above. You acknowledge that the University does not need to provide prior notification of any distribution and representation of the Content, is not obliged to use the Content and has the discretion to use or remove the Content, in whole or in part, from any communication or media without prior notice to you.

These terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
